Hà Nội "quên" thu hồi 100 tỷ đồng sai phạm?
Dân trí Thanh tra Chính phủ phát hiện tại dự án đầu tư phát triển cơ sở hạ tầng đô thị Bắc Thăng Long - Vân Trì có sai phạm giá trị lớn, gần 100 tỷ đồng, nhưng không được UBND TP Hà Nội đốc thúc thu hồi, có tính chất buông xuôi trong thời gian dài, dẫn đến việc thu hồi số tiền sai phạm về ngân sách Nhà nước bị thất thoát.
Ngày 9/12, ông Nguyễn Đức Hạnh- Phó tổng Thanh tra Chính phủ đã ký thông báo Kết luận thanh tra dự án đầu tư phát triển cơ sở hạ tầng đô thị Bắc Thăng Long - Vân Trì (huyện Đông Anh, Hà Nội).
Đây là dự án lớn của Hà Nội được Thủ tướng Chính phủ phê duyệt năm 1997 nhưng đến năm 2002 mới bắt đầu triển khai. Dự án có tổng vốn đầu tư hơn 100 triệu USD, trong đó vốn ODA (vay ưu đãi của Nhật Bản) là 18 triệu USD, vốn trong nước 104 triệu USD.
Theo kết luận thanh tra, UBND TP Hà Nội và chủ đầu tư chậm thực hiện dự án khi dự án được Thủ tướng phê duyệt từ tháng 10/1997 nhưng đến đầu năm 2002 mới được triển khai. Tuy vậy, UBND TP Hà Nội không thực hiện lập, thẩm định, phê duyệt quy hoạch chi tiết sát với thực tế theo chỉ đạo của Thủ tướng Chính phủ dẫn đến tổng mức đầu tư và quy mô dự án phải điều chỉnh bổ sung tới 4 lần.
Việc tổ chức thực hiện chậm, không đảm bảo thời hạn như đã cam kết trong Hiệp định vay vốn ODA khiến phải điều chỉnh giảm nguồn vốn ODA, tăng vốn trong nước và thời gian hoàn thành dự án, dẫn đến hiệu quả sử dụng nguồn vốn ODA không cao.
Thanh tra Chính phủ cũng chỉ ra những sai phạm tại gói thầu CP2 - Hệ thống đường và hệ thống thoát nước sử dụng vốn ODA (giai đoạn sau năm 2006). Ở gói thầu này, chủ đầu tư ban hành 8 quyết định phê duyệt điều chỉnh thiết kế, dự toán của gói thầu CP2 nhưng đều không thẩm tra, thẩm định khối lượng, vi phạm các quy định của Chính phủ về quản lý chi phí đầu tư xây dựng công trình.
Hạng mục kênh Việt Thắng thực hiện không đúng với thiết kế đã được phê duyệt, lớp cát đệm 15cm không đủ chiều dày ở nhiều vị trí, khối lượng thiếu so với thiết kế, thành tiền trên 547 triệu đồng và 4 triệu yên Nhật.
Đáng chú ý nhất là việc bán thầu của một số nhà thầu sau khi trúng thầu sai quy định, thu lợi bất chính đã bị Thanh tra Chính phủ phát giác. Cụ thể, tại gói thầu số 4, nhà thầu thi công xây dựng là Tổng công ty Xây dựng Hà Nội, qua 2 lần chuyển nhượng trái phép thu hơn 3,96 tỷ đồng; gói thầu 8 giếng ngoài đê, nhà thầu thi công là Tổng công ty Cấp thoát nước và môi trường Việt Nam, qua 2 lần chuyển nhượng trái phép thu gần 1,66 tỉ đồng vi phạm khoản 14, điều 12 Luật Đấu thầu.
Việc điều chỉnh thiết kế đối với một số hạng mục của gói thầu xây dựng số 02, 04, 05 liên quan đến đường nối kênh Giữa, đường Gom thuộc gói thầu CP2 đã dẫn tới lãng phí trên 1,9 tỷ đồng, vi phạm Nghị định 209/2004 của Chính phủ về quản lý chất lượng công trình xây dựng.
Thanh tra Chính phủ phát hiện UBND TP Hà Nội khi tiến hành thanh tra gói thầu CP1-Nhà máy cấp nước thuộc dự án (năm 2006) không thực hiện đúng quy định hoạt động thanh tra, không kết luận thanh tra khi đã có kết quả thanh tra của Đoàn thanh tra (8 năm), vi phạm Luật Thanh tra năm 2004 (?!).
“Một số nội dung kết luận, kiến nghị của các cơ quan kiểm toán, điều tra, xét xử không được UBND TP Hà Nội đôn đốc chỉ đạo triệt để, có tính chất buông xuôi trong thời gian dài, dẫn đến việc thu hồi số tiền sai phạm về ngân sách Nhà nước bị thất thoát. Hiện vẫn còn số lượng tiền lớn sai phạm cho đến nay chưa thực hiện”- kết luận thanh tra nêu rõ.
Cụ thể, năm 2008 Kiểm toán Nhà nước khi kiểm toán tại dự án này đã kiến nghị thu hồi khoản tiền sai phạm hơn 81,3 tỉ đồng. Đến năm 2013, dự án này lại liên quan đến một vụ án hình sự và Tòa phúc thẩm TAND Tối cao tại Hà Nội đã tuyên thu hồi hơn 16,3 tỉ đồng sai phạm. Tuy nhiên cả hai khoản tiền này đến nay vẫn chưa thu hồi được.
Kết luận của Thanh tra Chính phủ khẳng định những sai phạm trong thực hiện dự án này trách nhiệm thuộc UBND TP Hà Nội, chủ đầu tư là ban quản lý các dự án trọng điểm phát triển đô thị Hà Nội và các cơ quan, đơn vị, cá nhân liên quan qua các thời kỳ. UBND TP Hà Nội phải chấn chỉnh toàn bộ tồn tại, sai phạm trong công tác quản lý dự án đầu tư xây dựng đã được nêu trong kết luận thanh tra.
Thanh tra Chính phủ kiến nghị xử lý về tài chính với sai phạm tài chính ở một số gói thầu của dự án qua thanh tra với tổng số tiền hơn 13,3 tỉ đồng và hơn 4 triệu yen Nhật cùng số tiền hơn 3,27 tỉ đồng thuộc chi phí khác do không thực hiện.
Trong đó, Thanh tra Chính phủ sẽ thu hồi về tài khoản tạm giữ số tiền hơn 5,62 tỉ đồng gồm các khoản chuyển nhượng thầu trái phép của Tổng Công ty Xây dựng Hà Nội, Công ty Cổ phần Thiết bị và vật liệu xây dựng Hancorp, Tổng Công ty Cấp thoát nước và môi trường Việt Nam và Công ty Cổ phần Xây dựng cấp thoát nước số 01. Đồng thời xem xét loại khỏi quyết toán số tiền hơn 7,67 tỉ đồng và hơn 4 triệu yên Nhật trong đó có nhiều hạng mục có giá trị lớn của Tổng Công ty Đầu tư và phát triển nhà Hà Nội và Tổng Công ty Xây dựng Hà Nội…
Thanh tra Chính phủ kiến nghị Thủ tướng Chính phủ chỉ đạo UBND TP Hà Nội kiểm điểm nghiêm túc trách nhiệm của tập thể UBND TP và cá nhân có liên quan trong chỉ đạo điều hành, triển khai thực hiện dự án. Chỉ đạo chủ đầu tư, các đơn vị liên quan kiểm điểm tập thể, cá nhân có liên quan và có hình thức xử lý đúng quy định của pháp luật.
Phó Thủ tướng Nguyễn Xuân Phúc đã đồng ý với các kết luận, kiến nghị được nêu ra trong kết luận thanh tra và yêu cầu UBND TP Hà Nội tổ chức thực hiện.
