Trừ trường hợp Hợp Đồng có quy định khác,
(i) Bên Thế Chấp được khai thác công dụng, hưởng lợi tức thu được từ Tài Sản Bảo Đảm (nếu lợi tức không thuộc Tài Sản Bảo Đảm) .
(ii) Bên Thế Chấp được cho thuê, cho mượn Tài Sản Bảo Đảm sau khi được Ngân Hàng đồng ý bằng văn bản. Khi Tài Sản Bảo Đảm bị xử lý thì hợp đồng cho thuê, cho mượn đương nhiên hết hiệu lực. Bên Thế Chấp phải thông báo cho bên thuê, bên mượn về việc Tài Sản Bảo Đảm đang được dùng để thế chấp tại Ngân Hàng và việc phải chấm dứt hợp đồng cho thuê, cho mượn trước thời hạn nếu Tài Sản Bảo Đảm bị xử lý để thực hiện Nghĩa Vụ Được Bảo Đảm
